These Rules govern the operation of referral, notification, claiming, allocation, intake administration and handoff functionality made available through CabRank. CabRank does not provide court, matter, file, billing, trust accounting, conveyancing or case management functionality. Participants remain solely responsible for those functions in their own systems.
1.1 These Rules govern how legal enquiries, referrals, leads, opportunities and notifications are surfaced, allocated, claimed, responded to, released, reallocated and administered within CabRank for referral and intake purposes only.
2.1 Participation in CabRank does not guarantee any minimum number of referrals, leads, matters, bookings, enquiries, or notifications, any minimum revenue or commercial outcome, or that any client will engage a Participant.
2.2 Unless expressly stated otherwise by Platfirm in writing, referrals and opportunities are non-exclusive.
3.1 CabRank may make opportunities available by any method determined by Platfirm, including in-app display, email notification, SMS notification, filtered visibility, direct allocation, priority access logic, or staged release to different users or groups.
3.2 Platfirm may determine how, when, to whom, and in what sequence opportunities are surfaced.
4.1 A Participant may only receive or act on an opportunity if the Participant is approved by Platfirm, properly entitled to provide the relevant legal services, appropriately configured for the relevant practice area or opportunity type, and not suspended or otherwise ineligible.
4.2 Platfirm may apply additional eligibility criteria at any time, including criteria based on location, practice area, response history, account status, subscription tier, activity levels, quality indicators, ratings or trust factors, compliance concerns, or client experience considerations.
5.1 An opportunity may be displayed for claim, offered for acceptance, directly allocated, conditionally reserved, or reissued after non-response or rejection.
5.2 A Participant must not claim or accept an opportunity unless it genuinely intends to assess and, if appropriate, respond promptly and professionally.
5.3 Platfirm may impose claim windows, expiry periods, response deadlines, confirmation requirements, maximum active claim limits, and release requirements for unworked opportunities.
5.4 A Participant must promptly decline, release, or refrain from claiming an opportunity if it is conflicted, lacks capacity, lacks appropriate expertise, cannot respond promptly, or is otherwise unsuitable to act.
6.1 A Participant does not acquire any ownership right, exclusivity right, vested right, or proprietary interest in an opportunity merely because it is displayed in CabRank, notified to the Participant, matches the Participant’s filters, is viewed, is temporarily reserved, or is claimed but not yet confirmed.
6.2 Platfirm may withdraw, correct, suspend, reissue, or reallocate any opportunity at any time before final confirmation.
7.1 A Participant that claims, accepts, or is allocated an opportunity must use reasonable efforts to review the opportunity promptly, contact the prospective client promptly where appropriate, act professionally and courteously, avoid unnecessary delay, and update statuses or outcomes where the platform requires this.
7.2 If a Participant is non-responsive, slow to respond, persistently inactive, or fails to engage appropriately, Platfirm may deprioritise the Participant, restrict claiming rights, reallocate opportunities, suspend the account, or impose other reasonable controls.
8.1 Platfirm may reallocate, reissue, or withdraw an opportunity where the Participant does not respond in time, declines or releases it, appears unable or unwilling to act, the information changes materially, a complaint arises, the client is at risk of delay or poor service, a system or operational issue occurs, or Platfirm reasonably considers reallocation appropriate for client service or network integrity.
9.1 CabRank may operate using dynamic ranking, filtering, or priority logic.
9.2 Platfirm may take into account subscription tier, activity levels, responsiveness, practice-area relevance, geography, account completeness, professional history with the platform, client feedback, trust or quality indicators, demand and supply balancing, operational fairness, and current promotions or pilot programs.
9.3 Different plans may receive different features, visibility settings, referral tools, priority settings, allocation advantages, support levels, or opportunities.
9.4 Free membership may provide access to baseline network functionality, while paid plans may provide enhanced platform access, referral tools, intake tools, handoff tools and priority features.
10.1 CabRank may use Claim Credits, scores, trust indicators, or other dynamic allocation systems.
10.2 Unless expressly stated otherwise:
(a) Claim Credits are a contractual platform mechanism only;
(b) Claim Credits are not money;
(c) Claim Credits are not transferable property;
(d) Claim Credits have no cash value; and
(e) Claim Credits are not redeemable for cash.
10.3 Platfirm may create, amend, suspend, or remove any Claim Credit, scoring, rating, weighting, multiplier, or similar system prospectively.
11.1 All Participants must act lawfully, ethically, and professionally.
11.2 A Participant must not manipulate or game the platform, claim opportunities without genuine intention or ability to act, delay clients unnecessarily, provide misleading or poor treatment, misuse client information, interfere with other Participants’ use of the platform, scrape or harvest data, or use CabRank in a way that harms clients, Platfirm, or the network.
11.3 Participants remain solely responsible for legal advice, conflict checking, retainers, costs disclosure, trust accounting, file conduct, limitation dates, legal ethics, privacy compliance, court obligations and matter management in their own systems.
11.4 CabRank does not provide court, matter, file, billing, trust accounting, conveyancing or case management functionality.
12.1 Information received through CabRank may only be used for assessing the referral opportunity, contacting the prospective client, deciding whether to act, and taking related administrative actions reasonably necessary for that purpose. If the Participant accepts instructions, all ongoing matter handling must occur in the Participant’s own systems and under the Participant’s own professional responsibility.
12.2 A Participant must not use information obtained through CabRank for unrelated marketing, to compile unrelated databases, for resale or onward disclosure except as reasonably required to handle the enquiry lawfully, or in any way inconsistent with law, professional obligations, or platform terms.
12.3 All client and enquiry information must be handled securely and confidentially.
13.1 Platfirm may receive and investigate complaints relating to Participants, opportunities, client treatment, responsiveness, or service quality.
13.2 Platfirm may take reasonable action in response to complaints or quality concerns, including seeking information, issuing warnings, adjusting priority settings, restricting claiming rights, suspending access, or removing a Participant from the network.
14.1 Platfirm may suspend, restrict, or remove a Participant from referral functionality or the network if Platfirm reasonably considers that the Participant is in breach of applicable terms, no longer eligible, non-responsive, persistently inactive, subject to conduct or complaint issues, subject to regulatory or entitlement concerns, or engaged in misuse, fraud, gaming, scraping, or abuse.
15.1 CabRank is a dynamic platform.
15.2 Platfirm may amend these Rules from time to time, including rules relating to referrals, intake administration, handoff, notifications, claiming, priorities, scoring, credits, filters, eligibility, account controls, service levels, and plan entitlements.
15.3 If a change materially adversely affects a paid Customer during a current Subscription Term, the change will be subject to the change-management provisions of the applicable Master Subscription Agreement.
16.1 CabRank facilitates referral matching, intake administration, claiming, allocation, notification and handoff only.
16.2 Platfirm does not give legal advice to Participants, recommend that a Participant act for any person, guarantee that a Participant is suitable for any referral or legal enquiry, supervise the legal services provided by Participants, or become a party to any retainer or lawyer-client relationship.
